What's at stake if you miss 12 August

It's not a recommendation: it's Regulation (EU) 2025/40 (PPWR), the new European packaging law. And in Spain there is already a penalty regime that serves as a reference while the PPWR-specific one is approved.

Sale banned

Packaging without paperwork can't be marketed

From 12-08-2026, each type of packaging placed on the EU market must have its declaration of conformity (art. 39 and Annex VIII) and its technical documentation (Annex VII). Without them, an inspection can stop the sale and order the product withdrawn.

Fine for a serious infringement in Spain

Law 7/2022 on waste and contaminated soil —the Spanish reference penalty framework for packaging— sets fines from 2,001 to 100,000 € for serious infringements (art. 109.1.b).

Very serious infringements range from 100,001 up to 3,500,000 €, with possible disqualification and closure (art. 109.1.a). The PPWR also requires each Member State to have its penalty regime applicable from 12-08-2026 (art. 68).

Section 03

Does it affect me?

The quick rule: if you make packaging, if you pack your product or if you import product already packaged, it affects you. The law spreads duties across the whole chain and being small doesn't exempt you: the rule doesn't distinguish by size. Real profile example: a cannery in Murcia with 8 different packaging items (cans, jars, boxes) needs 8 declarations with their documentation. With ConformaPack it has them all in one afternoon.

Packaging manufacturers

You make cans, bottles, boxes, bags… The heavy part falls to you: preparing the technical documentation and signing the declaration of conformity for each type of packaging.

Importers

You bring packaging or packaged product from outside the EU. Before selling it, you must check that the manufacturer did their homework and keep a copy of their paperwork in case it's requested.

Packers and brands

You pack preserves, cosmetics, drinks, honey… or order packaging with your brand. For the law you may count as a manufacturer, with the same obligations. It doesn't matter if there are only three of you in the company.

Do you sell online with your own boxes, envelopes or filler? That shipping packaging also counts as packaging under this law. And if you resell, you must check that your suppliers have the paperwork.

The PPWR replaces the 1994 packaging rule. The year-and-a-half window to adapt begins.

Paperwork D-day

From today, each type of packaging needs its signed declaration of conformity (art. 39, Annex VIII) and its technical documentation (Annex VII). And PFAS are banned in food-contact packaging.

And the paperwork is kept

It's not just for a day: it must be kept 5 years (single-use packaging) or 10 years (reusable), in case an inspection requests it.

New labels

All EU packaging will carry the same material symbols (art. 12). Labels will have to change again.

Genuinely recyclable

Packaging must be recyclable at least at grade C, and plastic packaging must carry recycled content.

Top grades only

Final cut: only packaging with the two best recyclability grades (A and B) can be sold.

What ConformaPack is — and what it isn't

ConformaPack is a documentary support tool, not legal advice: it drafts and organises the declaration and the technical documentation following the official models of Regulation (EU) 2025/40. The declaration of conformity is always signed by the person responsible in your company, who places the packaging on the market and is answerable for its compliance. We are not a notified body (an official certifying entity), nor a laboratory, nor a law firm, and using ConformaPack is not legal advice. For complex cases, check with your adviser.

Frequently asked questions

What exactly is the declaration of conformity?

A one-page document in which your company states, in black and white, that a type of packaging complies with the European packaging law: what materials it uses, that it has no prohibited substances, that it's recyclable, etc. It's signed by someone responsible in the company and follows an official model (Regulation (EU) 2025/40, art. 39 and Annex VIII).

No one issues it to you from outside: it's a self-declaration. But it must be backed by technical documentation that proves what you sign (Annex VII). That's where the real work is, and that's exactly what ConformaPack prepares for you.

Does someone have to come and certify or audit me?

No. The law says the control is carried out by the company itself (so-called "internal production control", Annex VII of the Regulation). There is no external auditor or certifier involved. That said: to back up some claims —for example, that there are no PFAS (very persistent chemicals) in food-contact packaging— you may need data from your suppliers or a laboratory test. ConformaPack tells you which ones and where to file them.

Does a single declaration cover all my packaging?

No: it goes per type of packaging. The bottle, the cap, the label, the grouping box and the shipping box are different types; that's five declarations. That's why the packs cover 10 or 30 types, with a map of your catalogue so you don't miss any. (If a packaging item is subject to several EU rules at once, the Regulation allows a single combined declaration citing them all.)

What happens if 12 August 2026 arrives and I don't have it?

That packaging, legally, cannot be placed on sale in the EU. An inspection can request the paperwork and order the product withdrawn. In Spain, the reference penalty framework for packaging and waste is Law 7/2022: fines from 2,001 to 100,000 € for serious infringements and from 100,001 up to 3.5 million for very serious ones (art. 109). And before the inspection, something else usually arrives first: the large customer who won't buy from you without the documentation.

I'm a small online shop, does this really affect me?

Very probably yes. If you pack your own product, order packaging with your brand or import packaged product from outside the EU, it applies to you. And your boxes, envelopes and shipping filler also count as packaging under this law. If you only resell products already packaged by EU companies, your role is that of a distributor: your duty is to check that your suppliers have the paperwork. That the data is true and that the packaging genuinely complies is the responsibility of whoever signs: your company. Our side of the bargain: that paperwork isn't the reason you miss 12 August.

What Germany foresees, as an EU reference

The German draft transposing the PPWR envisages fines of 10,000 to 200,000 € per infringement (incomplete registration, non-compliance with the extended responsibility system, etc.), enforceable once the national penalty regime is set, at the latest by 12 February 2027. Each Member State must have its own (art. 68 of the Regulation).
